枫下茶话 / 法律 / 求助： 租车公司向我收取我认为不合理的修理费，请有经验和这方面的知识朋友指教如何处理,谢谢！！！事情的经过是：我在还车的时候，车子有些擦痕 (scratches)，有可能是以前租车的顾客留下来的，租车公司的工作人员说因为车是黑色的，掉漆的部分比较明显，如果是其他浅色的车就算了，然后租车公司在没有我同意的情况下将车开到他们的车辆美容中心，从我的信用卡里直接划了大约600刀，寄给我的发票显示大约有400刀是人工费，每小时的人工费超过40刀，这不是抢钱吗？更可气的是，没有和我商量的余地。
请问我是否可以请我的信用卡公司取消这个收费，如果取消，我将会面临什么样的法律问题，我有心和他们去法庭上讲理。

你如何证明这个scratch不是你造成的？租车之前他们会让你看一下全车外观，你看了么？另外$40/hr根本不叫抢钱。

The credit card company will not cancel the pmt since you have signed a contract with the rental company. Read your contract. You are liable for those losses. However, if you credit card company has insurance, you can claim it.

那家租车公司? 为啥不买保险, 如果不买就不要去小的租车公司. 这种方式是小出租公司抢钱的常用方式. 你没有赢的可能. 除非换车前拍照证明没有.

谢谢诸位的热心相助，我的信用卡公司可以支付修理费，可是我气愤租车公司的做法，所以决心告到小额法庭讨个公道，顺便也学习一些知识。当时取车的时候接近晚上6点，我下班后去他们办公室，他们也急下班，所以没有仔细查看车的外貌。而且车已经使用了快2年，公里数超过60，000了。
担心我自己写的英文不专业，请教一个英文模本，可以让我根据我的情况稍稍改动一下，然后立案的几句话，多谢!

这种维修一般是假的. 你可以要求维修报价, 记录和收据. 通常租车公司会做假, 即时做假你也要他们提供. 一旦做假性质不一样. 不能举证也要他们留下假记录.

我在合同里同意承担车的修理费，但合同里没有说明修理费由租车公司说了算，车是由租车公司弄到它自己的美容中心，没有经过和我沟通。

You are not the owner of the car. The owner of the car has the right to choose the shop. It's really none of your business which shop they choose.

Unfortunately that's how it is. You can spend the time going to court but you will not win. Just waste more time and $. I don't see why you want to do that.

Since the car rental company charged me, I believe the car repairing process should be my business. The company should let me participate the car repairing process to ensure my best interest..

Let's say you are driving a new car and a car hit your car from the back. Can you insist to bring your car back to dealer for repair or you would let the other car owner to decide where you are going to repair the car since he is going to pay.

The owner has to protect his best interest. It's his property. End of story. No need to argue. You won't win at court, period.
