枫下茶话 / 法律 / 求助: 朋友在公寓内的洗衣机排水管脱落造成公寓漏水, 物业和房东商量后直接请第三方进行处理, 估计所有费用要过万。房东没有买保险,所以费用要转嫁到朋友身上。因为朋友刚来加拿三个月,没有收入, 没有支付的能力。请问:
1. 房东在出租物业时是否有义务购买房屋的LIABILITY 保险?
2. 房东在出租物业时并没有要求朋友购买房屋保险, 是否房东存在过错?
3. 房东在出租物业时并向朋友解释租房法规,租赁合同上有一条款是, 房东已经向租客解释租房法规,但是在这一条款下, 朋友并没有签字。显然, 朋友并不知道此应该由房东提供的信息。
4. 如果房东向朋友要求支付此费用, 朋友是否必须立刻支付?
5. 个人建议朋友以责任认定不清为由拒绝支付,交由法院判决, 此举是否可行?

两个方案可以选择:1。商量商量少赔一点。租人家房子给弄坏了赔偿是理所当然的。以不知道为理由是自欺欺人。你是成年人,损坏东西赔偿是常识吧?
2。死猪不怕开水烫。就是没钱。爱咋咋地。(此乃下策)。

我查了房屋保险, LIABILITY部分就是COVER因为疏忽造成第三方的损失, 房东把物业作为商业用途出租, 却不买保险, 应该存在过错, 如果LIABILITY是商业出租物业的必须条件, 那屋主应该付权责. 朋友只应该对本身物业造成的损失提供赔偿, 而不应负责LIABILITY.

landlord's insurance does not cover tenants. If it is tenants' liability, then tenant have to be responsible for the damage.

Who installed the 洗衣机? and who owns 洗衣机? Try LRS from Ontario Law Society at 1-900-565-4LRS. Did your friend recently do any maintenance for 洗衣机?

Nothing to fear of ...法院判定是以责任为根据的。不知道租约里有无谁维护洗衣机的条款;个人觉得,如果无,就应该是房东负责。费用转嫁与有无保险无关,保险只不过是理应由个人负担的风险(责任)转移。觉得此事件最多是物业把房东和租客作共同被告。房东此时会尽力维护最后判决结果对自己有力,租客作为弱者也会受益,当然要尽力证明自己无责。

the key question is who caused 排水管脱落? If your friend did nothing to cause 排水管脱落 then it is not his responsibility.

可以明确的是一定有人要付这个帐单. 但不明白的是责任认定. 房东不买保险, 也没有提醒租客买保险, 是否存在过错?房东肯定会收到物业公司的帐单. 他必须付这个帐. 然后, 他会要求我的朋友还他钱. 问题是:
1. 房东可能存在过错, 朋友有过失. 现在需要责任认定, 然后按责任来分担. 我建议我的朋友在责任未明了之前, 不要把责任都揽在身上, 具体责任认定应该由法院说了才算, 如果法院判定100%是朋友的责任, 那就按法院要求支付帐单, 在法院未确定责任之前, 拒绝支付任何费用 是否可行?
2. 如果朋友无力承担全部责任, 有什么方法可以减少或者延缓帐单?

大多数公寓的租约合同中应该有说明,是不能自己装洗衣机的,后果自负。

Do not call a lawyer and just settle with the property management office to reduce your pay, if possible.Althoug you argue the landlord did not clearly explain the contract, the court has a rule: small error does not entirely override the whole contract. The court may reduce a little pay, but your risk of totall losing is also great. In addition, legal fee is much more expensive, even this small case, you final pay will be up to over 10000 dollars.

That's right. The leasing is not specifically release the responsibility of tenant from the consequences, and the owner is not occupy the dweller. The tenant should be responsible for the consequence.

it depends, if the problem is due to aging, poor maintenace, then the owner is responsible but if the tenant just did some renovation and move around the washing machine, then it is his fault and responsibility.

1. 义务不是责任,房东买不买保险与本案无关。2. 房东无过错。3. 如果朋友在整体合约上签字了,这一条款未签字不影响合同的有效性。4. 朋友可以不支付,但会吃官司。5. 朋友可以任意理由拒付,进入司法程序后,朋友的COST可能更高。以上所有答案的前提是双方有租约。。。
