Let's say you go to court, fight with landlord

1. If evidence stands, you will bear full responsibility for repair. as you said in 1), the landlord has pictures, probably with date on, what's your arguement of that?

Ontario Tenants Act, section 30: The tenant is responsible for the repair of damage to the rental unit or residential complex caused by the wilful or negligent conduct of the tenant, other occupants of the rental unit or persons who are permitted in the residential complex by the tenant. 1997, c. 24, s. 30.

2. The landlord kept all the bills, can you argue that they are not relevent to the damage you've done, or excessive?

    我之前的房东居然拒不退还我1200的房租, 说他花了3000 来休整房子, 硬说是我造成的damage. 而他所谓的damage是说我的做饭油烟以及在粉刷一扇墙壁时溅的漆. 这人还特有心计,留下所有的bill (天知道钱花在哪里), 并照了几张相.
    我想知道:
    1) 他的所谓证据有效吗? (如果有效, 他可以把整个房子装修一遍)
    2) 需要/值得打官司吗?
    我和他签的合同非常简单, 并无这些内容.
    若干天前还客气得一塌糊涂,我算是领教了西人的虚伪和贪婪.

    • 当然要据理力争,一千二百块啊,不是个小数啊,可以吃多少SLX啊。
    • 打,自己先化点钱找律师咨询,然后看相关法律,最后告他。1200 不是小数字。
      • 好像不用急着打官司,先找一下有一个政府部门管房东和房客关系的吧?
        • 有这样的政府部门吗? 门在哪里?

    • 到home depot问问(我以前刷过墙,忘了怎么计算的乐),一桶漆也就$20-$30,$1200够刷好几套房的了。
    • 很多细节要律师来下结论。
      他说的DAMAGE就是DAMAGE?在修整前和你确认是弥补你造成
      的DAMAGE了吗?好象他也没有确凿的证据,所以值得打,最好
      先咨询律师。

        • I am not taking side here, but the landlord has the photo and bills, what do you have to support your arguement, anything at all?
          • 我有他欠1200的欠条以及合同 (合同根本没有任何有关赔偿的条款).
            • 我的理解:房东欠你房租是一回事,说你造成damage要你赔应该是另一回事。如果法律上你手里的欠条有效,他就应该还你房租;他可以要求你赔偿,只要他能提供证据说服法庭这些开支该算你头上,该多少赔多少。把这两件事分开,应该对你有利。
