本文发表在 rolia.net 枫下论坛亲们 我自己建了一个阳光房,因离边界过近, Toronto City要求拆除或申请Permit。当时不懂,也不想拆除,就自己设计图纸,按照bylaw和Zone code, 移除了违章的部分,申请了building Permit。由于缺乏经验,设计与实际有小部分出入,无法closing。沮丧之余,我发现这个阳光房如果用塑料屋顶的话,根本不需要申请Permit。但是当我要求取消Permit的时候,City确要求我全部拆除,说这和bylaw没有关系,要恢复到申请permit之前的状态。具体是说我deviating from the plans.Work at the above location is in contravention of Section 8, Subsection (13) of the Building Code Act, S.O.1992, c.23, as amended,which states "no person shall construct or cause to be constructed a building in a municipality except in accordance with the plans,specifications, documents and any other information on the basis of which a permit was issued or any changes thereto authorized bythe Chief Building Official.从City给我列的罪状来看,我的那个阳光房也算不上个Buiding。在Building Code Act里面Buiding的定义如下:“building” means,(a) a structure occupying an area greater than ten square metres consisting of a wall, roof and floor or any of them or a structural system serving the function thereof including all plumbing, works, fixtures and service systems appurtenant thereto,我的阳光房只有12'x7'=84square feets, 也就8 square metres,而且目前还没有安屋顶,见附图。亲们 帮我看看怎么办好,要是上庭的话,有希望吗?要是输了的话,有什么严重后果吗?谢谢更多精彩文章及讨论,请光临枫下论坛 rolia.net
