On your purchase agreement, is there a condition called "vacant possession"? If there is and the seller can not hand over a vacant property on time at closing date

The seller shall pay all your expenses incurred because of this.

It works this way: you make the payment in full on closing date to your lawyer, your lawyer checks everything for you and make sure that all the conditions stated on the agreement are met at the time of closing before handing your money over to the seller's lawyer, the seller gets money from his/her lawyer.

Should any violation occurs such as you have encountered, inform your lawyer IMMEDIATELY, ask your lawyer to withhold part of the payment. The amount shall be sufficiently enough to cover your total loss.

All you have to do now is to provide your lawyer with an estimate of your total costs due to delayed closing.

If there is no such vacant possession clause on the agreement, you are toasted! You have got an either inexperienced or irresponsible agent.

        • 你说的“房东”,应该是卖房的原房主,而不是房东。你跟他的房屋交易合同中应该规定了,明天他必须把房子腾空。否则,一切损失由违约方负。所以,他们如果真的不交房,你就去找高级酒店住吧,原房主出钱。
    • 如果是因为建筑商的原因而延迟交房,你只好自己想办法;但是如果是因为前一手房东的原因,你应该通过你的律师找他们讨回公道,不然,花那么多钱请律师干嘛,一定要坚持自己的合法权益!

        • 没联系上?那你可以先狡猾地请教你的律师,遇到这种情况该怎么办?并且一定要告诉律师,这是对方毁约在先。千万别先过钱给对方,把钱放在自己口袋里,说话声音也可以响很多。

            • 如果你的合约明确写明了closing date, 而卖方又现在才通知你交不出房子,你可以把你的损失告诉律师,什么事由律师出面交涉。
